Alibaba International Digital Commerce Group is committed to protecting intellectual property rights in order to maintain a healthful and safe e-commerce environment and to preserve the trust that consumers and merchants place in us.
Our IP protection program rests on four pillars: efficient and effective notice and takedown procedures; proactive identification and removal of IP-infringing listings using our advanced technologies; support of law enforcement and rights holders on offline investigations; and robust stakeholder collaboration, including with rights holders, trade associations and government enforcement agencies.
Intellectual property rights holders, including their authorized representatives, can file complaints in the form of take-down requests on the Alibaba International Intellectual Property Protection platform (the “IPP” platform) on listed products or product descriptions that allegedly infringe their IPR.
Eligible complaints on the IPP platform including, but not limited to
- Trademark infringement, such as misuse of identical or confusingly similar marks.
- Copyright infringement, such as the sale of unauthorized copies of copyrighted works, including books, music, videos, software, video games, television programs, paintings and photographs, as well as unauthorized use of a third party’s copyrighted photographs in seller listings.
- Patent infringement, including of invention and design patents.
Our domestic platforms, such as the six country-sites which make up Lazada, accept takedown requests based on IP rights protectable in the country where that specific site operates, e.g., a takedown request for a listing on lazada.com.my, our Malaysian site, must be based on IP rights registered in Malaysia. Our international platforms, such as Alibaba.com and AliExpress, accept takedown requests based on IP rights registered in foreign jurisdictions, including the U.S. and the EU.
